Terms and conditions and privacy policy for the use of free wi-fi services

Article 1 – Definitions

For the purpose of these Terms and conditions:

  • ABC means N.V. Autobusbedrijf Curaçao
  • Users mean any person making use of the Wi-Fi Service;
  • Wi-Fi Service means the wireless internet access provided by ABC in general and on their premises, buses and designated bus stations.

Article 2 – Acceptance

By accessing or using the WI-Fi service, the user agrees to these Terms and Conditions and the accompanying Privacy Policy.

If user does not agree with these Terms and Conditions, the user shall refrain from using the WI-Fi service.

Article 3 – Availability of the Service

ABC provides the WI-FI Service on a best-efforts basis.

ABC does not guarantee uninterrupted access, speed, security, or availability of the Wi-Fi service and reserves the right to modify, suspend or discontinue the service at any time without prior notice.

Article 4 – Acceptable Use

Users should use the Wi-Fi Service in a responsible and lawful manner.

Users shall not:

  • Use the service for illegal purposes;
  • Transmit viruses or malicious software;
  • Interfere with the operation or security of the network;
  • Distribute unlawful, offensive or harmful content;
  • Infringe intellectuel property rights;
  • Engage in activities that may adversely affect other users.

ABC reserves the right to restrict or terminate access to the Wi-Fi Service in case of misuse.

Article 5 – User Responsibility

Users are responsible for:

  • Maintaining the security of their own devices;
  • Protecting their passwords and personal information;
  • Ensuring that their equipment is compatible with the Wi-Fi Service.

ABC recommends that users avoid transmitting confidential or sensitive information through the public Wi-Fi network.

Article 6 – Intellectual Property

The use of the Wi-Fi Service does not grant any intellectual property rights to users.

Users shall respect all applicable intellectual property laws and regulations.

Article 7 – Limitation of Liability

The Wi-Fi Service is provided on an “as is” and “as available” basis

ABC shall not be liable for:

  • Interruptions or failures of the service;
  • Delays in connectivity;
  • Loss of data;
  • Damages to devices;
  • Unauthorized access by third parties;
  • Indirect or consequential damage resulting from the use of the Wi-Fi Service.

Article 8 – Force Majeure

ABC shall not be liable for delays or failures resulting from circumstances beyond its reasonable control, including but not limited to:

  • Acts of government;
  • Failures of telecommunications providers;
  • Natural disasters;
  • Fire;
  • Floods;
  • Strikes;
  • Riots;
  • War;
  • Power outages;
